Terms of Use

These terms are an agreement between you and BalloonFlow AI. By using the BalloonFlow AI website or app, you agree to them. If you do not agree, do not use them.

Eligibility and accounts

You must be at least 18 and able to enter a binding contract. Keep your credentials secure. You are responsible for activity under your account.

Membership, free trial, and billing

BalloonFlow AI offers one membership, BalloonFlow Pro, at $29.99 per month.

• Eligible new subscribers receive a 7-day free trial. Eligibility is determined by Apple. The trial includes 3 AI garland checks, 3 AI backdrop mockups, and 3 Theme Studio plans, which is the allowance for the entire 7-day trial rather than a daily or monthly amount.
• After the trial, the subscription renews automatically at $29.99 per month until canceled.
• Payment is charged to your Apple Account at confirmation of purchase.
• The subscription renews automatically unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours of the end of the period.
• Manage or cancel in your Apple subscription settings. Deleting the app does not cancel the subscription.
• Apple handles billing, cancellation, restoration, and refunds under Apple policies. We cannot issue refunds for App Store purchases.
• Prices, features, and monthly AI allowances may change. We will give notice of price changes as required.

What the membership includes

Once the paid membership begins, it includes monthly AI allowances of 30 AI garland checks, 30 AI backdrop mockups, and 20 Theme Studio plans, with up to 15 Expert suggestions per analysis. These paid allowances are separate from, and larger than, the 3 checks, 3 mockups, and 3 Theme Studio plans granted for the free trial. Allowances reset monthly and unused usage does not roll over. AI access is metered and is not unlimited.

AI results are suggestions, not professional advice

Garland scoring, placement markers, quantity estimates, palettes, and pricing suggestions are generated automatically and can be wrong. You are responsible for verifying quantities, costs, structural safety, rigging, and installation before any event. BalloonFlow AI does not replace a professional installation or safety review.

Proposals and contracts

Templates and generated agreements are provided for convenience and are not legal advice. You are responsible for the contracts you send and for compliance with the law where you operate. Have a lawyer review any agreement you rely on.

Payments from your clients

Client deposits and balances are paid through your own connected Square account. The app never charges your customer automatically; the customer has to press the secure payment button. We are not a party to your transactions with your clients and we do not hold your funds. Your use of Square is governed by Square terms.

Your content

You keep ownership of the photos, designs, client data, and posts you upload. You grant us a limited license to host, process, display, and back up that content so we can run the service, and to display Community content you choose to publish. You confirm you have the rights to everything you upload.

Acceptable use

Do not use the service for unlawful content, do not infringe other people work, and do not upload photos of people without their permission. Do not scrape, reverse engineer, resell AI output as a competing service, or interfere with the service or other users. Community use is also governed by the Community Guidelines.

Suspension and termination

We may suspend or close accounts that break these terms. You can stop using the service at any time. Cancel through Apple to stop billing.

Disclaimers

The service is provided as is, without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted or error free, or that AI output will be accurate.

Limitation of liability

To the fullest extent permitted by law, our total liability arising from the service is limited to the amount you paid in the 12 months before the claim. We are not liable for indirect, incidental, or consequential damages, or for lost profits, events, or bookings.

Changes

We may update these terms and will post the new version here with a revised date.

Governing law

These terms are governed by the laws of the United States and of the state in which BalloonFlow AI is established, without regard to conflict of law rules.
